These Terms of Use (the "Terms") govern the relationship between you (the "User") and the operator of the Arcivéo site (the "Operator", "we") when using the arciveo.com website, the security monitoring software, and related services. By using the site or the product, you confirm that you have read, understood, and accept these Terms.

1.General provisions

These Terms constitute a legally binding agreement. If you do not agree with any of the provisions, please do not use the website or the product.

Operator. The Operator is the copyright holder of the Arcivéo software and the owner of the arciveo.com website. You can contact the Operator at support@arciveo.com.

We may update these Terms from time to time. The current version is always available on this page, and the date of the last change is shown above.

Geographic restrictions. The Service is not available to individuals or legal entities located in the Russian Federation, the Republic of Belarus, Cuba, Iran, North Korea, Syria, or the temporarily occupied territories of Ukraine, nor to residents of these countries and territories regardless of their actual location. The same applies to persons included in the sanctions lists of the UN, EU, UK, or USA. By using the Service, you confirm that you are not subject to this restriction. If a violation is detected, the Operator may refuse service, block access, or terminate the account; refunds of any amounts paid are handled in accordance with the "Refund Policy".

2.Service description

Arcivéo is a self-hosted security monitoring dashboard for Linux servers (VPS/VDS and dedicated servers). The product combines IDS/IPS, antivirus, WAF, audit, file integrity, and notification modules. The software is installed and runs on your own server. We do not access your servers and do not store monitoring data on our side.

3.License and its limitations

After payment, the Operator provides you with the distribution and a limited, non-exclusive, non-transferable license to install and use the software in accordance with the selected plan. On the first purchase, the license is granted for 1 year. The license does not renew automatically. When it expires, you can purchase a renewal separately — for 1 month, 3 months, 6 months, or 1 year — and activate it in your account. You may not: - resell, sublicense, or distribute the software without written permission; - decompile, disassemble, or otherwise attempt to obtain the source code, except where expressly permitted by law; - remove or alter copyright notices or other rights holder markings; - use the product in circumvention of the license or plan terms.

4.Account

Purchasing and managing licenses is done through your account at my.arciveo.com. You are responsible for keeping your credentials secure and for all actions taken under your account. Please notify us immediately of any unauthorized access to your account.

5.License payment and renewal

Payments are processed through third-party payment providers: PayPro Global and Freemius, Inc. (bank cards and PayPal) and NOWPayments (cryptocurrency).

Merchant of Record. For card or PayPal payments, the Merchant of Record is the provider handling the payment: PayPro Global, Inc. or an affiliated entity (PayPro Europe Limited, PPG DIGITAL Sp. z o.o., PayPro U.S. Inc.), or Freemius, Inc. The transaction is made on their behalf; they process the settlement, charge applicable taxes, and issue the receipt. On your card statement, the payment appears as PAYPRO* or FREEMIUS* with the product name. Such purchases are also subject to the terms and refund procedures of the respective provider. For cryptocurrency payments through NOWPayments, the transaction is made directly with the Operator, and the Operator is the Merchant of Record.

All payments are one-time — there are no automatic charges or subscriptions. With your first purchase you receive the distribution and a 1-year license. To keep using the product after it expires, you separately purchase a renewal (for 1, 3, 6, or 12 months) and activate it in your account. Pricing and plan details are listed on the "Pricing" page. Refund terms are described in the "Refund Policy".

6.Acceptable use

Arcivéo is intended solely for monitoring servers that you own or lawfully manage. You may not use the product for: unauthorized access to others' systems, networks, or data; carrying out attacks, scans, or other actions against third-party infrastructure without their consent; or any activity that violates applicable law.

7.Intellectual property

All rights to the software, source code, design, trademarks, logos, and site materials belong to the Operator and are protected by law. The license does not grant you any intellectual property rights other than those expressly stated in these Terms.

8.Disclaimer of warranties

The software is provided “as is” and “as available”, without any express or implied warranties, including, but not limited to, warranties of fitness for a particular purpose, uninterrupted operation, and freedom from errors.

Arcivéo is a tool that improves your security posture but does not guarantee absolute protection against all threats. Responsibility for configuring, updating, and maintaining server security remains with the User.

9.Limitation of Liability

To the maximum extent permitted by law, the Operator shall not be liable for any indirect, incidental, or consequential damages, lost profits, data loss, or business interruption arising from the use or inability to use the product.

In any case, the Operator's aggregate liability shall not exceed the amount actually paid by you for the product over the last 12 months.

10.Termination

We may suspend or terminate your license if you breach these Terms. Upon termination, you must stop using and delete the software. You may stop using the product at any time. Since payments are one-time, there is no subscription to cancel — once the term ends, the license simply is not renewed.

11.Changes to the Terms

We may modify these Terms. By continuing to use the site or product after changes are published, you accept the updated version.

12.Governing law

The parties seek to resolve any disputes through negotiation. Before going to court, contact us at support@arciveo.com — most issues are resolved in the normal course of business.

For card payments, the merchant of record is the payment partner, and its terms apply to the transaction, including provisions on the applicable law and dispute resolution.

If you are a consumer, you retain all rights granted to you by the mandatory provisions of the law of your country of residence; these Terms do not limit them. Otherwise, the relations between the parties are governed by the law applicable by operation of law.
